PLEASE READ CAREFULLY — THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS
1. Voluntary Participation & Assumption of Risk
I acknowledge and agree that running, walking, or participating in a road event is a potentially
hazardous athletic activity which may involve risks, including but not limited to:
risk of physical injury, illness, or even death;
slips, falls, collisions with other participants, spectators, or vehicles;
surface hazards (uneven pavement, curbs, potholes, debris, road obstructions);
weather conditions (heat, cold, rain, wind, humidity);
traffic or interaction with motor vehicles, bicycles, other participants or animals;
equipment failure, participant negligence, or the negligence of others (including the event
organizers, volunteers, or sponsors).
I certify that I am physically fit, have sufficiently trained for participation, and have no medical condition
which would make participation unsafe. I assume full responsibility for my own safety, and I knowingly
assume all risks inherent in the event, whether foreseen or unforeseen, including the possibility of
negligence on the part of the Released Parties (defined below).
2. Waiver, Release, and Covenant Not to Sue
In consideration for being permitted to participate in the Moss Creek Turkey Trot, I, for myself, my heirs,
executors, administrators, representatives, agents, successors and assigns, covenant not to sue, and
hereby waive, release, and forever discharge Moss Creek (and its affiliated entities), the event
organizers, race directors, sponsors, volunteers, agents, employees, contractors, local municipalities,
property owners, and all other parties involved in organizing or supporting the event (collectively, the
“Released Parties”) from any and every claim, liability, demand, cause of action, damage, loss, or
expense (including attorney’s fees and court costs) arising out of or in any way connected with my
participation in the event, whether caused by negligence or otherwise, to the fullest extent allowed by
law.
3. Indemnification
I agree to defend, indemnify, and hold harmless the Released Parties from and against all losses,
liabilities, claims, demands, costs, damages, or expenses (including attorneys’ fees and court costs)
incurred by them arising out of or related to my participation in the event or any breach of this
agreement by me.
4. Medical Treatment / Emergency Care
I authorize the Released Parties and event medical personnel to provide or arrange for emergency
medical care or treatment deemed necessary during my participation. I understand I am solely
responsible for any medical or other costs incurred as a result.
5. Use of Likeness / Publicity
I grant full permission to the Released Parties to photograph, record, or otherwise capture images or
recordings of me in connection with the event, and to use or publish my name, image, likeness, and any
performance statistics (e.g., finishing time) in any media for promotional, commercial, or educational
purposes, without compensation or further notice.
6. Compliance with Rules & Race Officials
I agree to abide by all event rules, instructions, and directions of race officials, volunteers, and course
marshals. I consent to the right of any official to deny or suspend my participation for any reason,
including for medical concerns or safety.
7. No Refunds / Cancellation
I understand and agree that if the event is canceled, delayed, or altered (in whole or in part) for any
reason (including acts of nature, pandemics, government orders, or other unforeseen circumstances), I
am not entitled to a refund, reimbursement, or claim for damages (unless otherwise stated in event
materials).
8. Severability & Governing Law
If any portion of this agreement is found to be invalid, unenforceable or void under applicable law, the
remaining portions shall continue in full force and effect. This agreement is intended to be as broad and
inclusive as allowed by South Carolina law and shall be governed by and construed in accordance with
the laws of the State of South Carolina. Any legal action or proceeding arising hereunder shall be
brought exclusively in the courts of South Carolina (or the county in which the event is held).
9. Acknowledgement & Understanding
I acknowledge that I have read this waiver in its entirety, understand its terms, and agree that by signing
below I am giving up substantial rights, including my right to sue the Released Parties. I am signing it
voluntarily and without inducement or duress on my part.
If the participant is a minor (under age 18), a parent or legal guardian must sign below.
