ALBION WHEELERS TIME TRIAL ENTRY FORM & DISCLAIMER THIS ENTRY FORM AND INDEMNITY APPLIES TO ALL EVENTS NO PERSON WILL BE ALLOWED TO TAKE PART IN AN EVENT IF THIS DOCUMENT HAS NOT BEEN READ AND SIGNED FOR PRIOR TO YOUR PARTICIPATION ACKNOWLEDGEMENT WILL BE SIGNED ON DAY OF PARTICIPATION CATEGORIES Your Category is determined by your age on 31 December 2022 JUNIOR U19 MASTER VET 50 to 59 years of age SENIOR 19 to 29 years of age GRAND MASTER VET 60 years and over JUNIOR VET 30 to 39 years of age LADIES Up to 39 years of age SENIOR VET 40 to 49 years of age LADIES 40+ 40 years and over RULES 1. Helmets are to be used during every event (No helmet, no ride) 2. Events start at 14:00 and each event carries a R50 donation. (Payable on day of participation) 3. All rules of the road as laid out by the South African Road Ordinance Act are to be adhered to. 4. Due to weather and road safety conditions, Albion Wheelers has the right to cancel an event at any time and is under no obligation to arrange an alternative event. 5. To qualify for a prize, a participant must complete at least 3 out of the 5 events (excl fun TTT). 6. All decisions are final. 7. Race venues and times may be changed at any time. All possible attempts will be made to notify participants of any such changes. 8. Marshals may be posted at potentially dangerous intersections to assist with the safe crossings. Instructions from such marshals are to be adhered to at all times. Page 2 of 2 ALBION WHEELERS CYCLING CLUB – 2022 TIME TRIAL SERIES WARNING, ASSUMPTION OF RISK, LIABILITY RELEASE, HOLD HARMLESS AND INDEMNITY AGREEMENT. PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS. The competitor identified is at least 18 years old, or if competitor is younger than 18 (the “Minor”), the Minor’s parent or legal guardian has read this agreement and has signed it on behalf of him / herself and the Minor if applicable. The adult competitor or the Minor’s parent or legal guardian, will be referred to herein as “adult”, and Adult and Minor are collectively referred to as the “Undersigned”. “Competitor” refers to the person actually taking part in the Albion Wheelers’ Time Trial Series. The Undersigned understand that the competitor will not be permitted to take part in the Event unless this Warning, Assumption of Risk, Liability Release, Hold Harmless and Indemnity Agreement (“Agreement”) is fully executed. TIME TRIALING IS A DANGEROUS AND HAZARDOUS ACTIVITY WHICH CAN RESULT IN SERIOUS INJURY OR DEATH. There are risks inherent in time trialing, including but not limited to high speeds, traffic intersections, poor surface conditions, loose gravel and dirt, rocks of various sizes, wet surfaces, other cyclists, vehicles and unpredictably changing weather conditions. Road conditions may change quickly due to weather, use and other factors and may not be the same during a race as during practice or inspections by Competitor. Time trialing may be more HAZARDOUS than recreational riding. RECOGNIZING THE RISKS, ADULT VOLUNTARILY CHOOSES TO TAKE PART IN THE EVENT AND, IF APPLICABLE VOLUNTARILY CHOOSES TO ALLOW MINOR TO TAKE PART IN THE EVENT AND REPRESENT THAT COMPETITOR HAS THE SKILLS AND DECTERITY TO PARTICIPATE IN THE EVENT AND WILL AT ALL TIMES RIDE WITHIN HIS / HER ABILITIES. By signing this Agreement adult on his her own behalf and, if applicable, on behalf of Minor acknowledges the general risks described above and the specific risks associated with the Event and, as a condition to Competitor engaging in the Event, Adult on his / her own behalf and, if applicable, on behalf of Minor agrees to (1) ASSUME ANY AND ALL RISKS OF INJURY OR DEATH to the COMPETITOR while, or as a result of participating in the Event; (2) RELEASE HOLD HARMLESS and WILL NOT SUE, MAKE ANY CLAIMS OR FILE ANY ACTIONS against Albion Wheelers cycling Club, it’s committee members, representatives and volunteers, as well as any operator of a venue for an Event, equipment manufacturers and distributors (hereinafter the “Indemnified Parties” that are based on or that result from, in whole or in part, participation in the Event; (3) INDEMNIFY and DEFEND THE INDEMNIFIED PARTIES FROM ANY LIABILITY, claims, demands, actions, and causes of actions whatsoever arising out of or related to any loss, damage or injury, including death, that may be sustained by Competitor or caused to others or their property by Competitor while taking part in the Event, including, but not limited to those injuries and damages caused by negligence and / or breach of warranty, express or implied, on the part of the Indemnified Parties. Undersigned agrees to pay all costs including attorney’s fees incurred by any Indemnified Party in defending a claim or suit brought by or on behalf of the Undersigned. Prior to a race Competitor will inspect his / her bicycle and assure him / herself that it is in good operating order and can be safely used in the Event. HELMETS ARE REQUIRED FOR ALL COMPETITORS IN THE Event and Undersigned agrees that Competitor will wear a helmet at all times and operate his / her bicycle only on marked roads. Competitor is a Competitor at all times, whether warming up, practicing for competition or while engaged in competition for every race in the Event. The Undersigned warrants and represents that Competitor is in good health and there are no special problems associated with the care of the Competitor to a medical facility if, in the opinion of such personnel, medical attention is needed for the Competitor. It is agreed that upon transport to any medical facility, Albion Wheelers shall not have any further responsibility for the Competitor , and all cost associated with such medical care and related transportation provided for the Competitor shall be paid by the Undersigned and the Undersigned does hereby indemnify and hold harmless Albion Wheelers of and from any costs incurred therein. Any and ALL DISPUTES between the Undersigned and any of the Indemnified Parties, arising from the Competitor’s participation in the Event, and INCLUDING any claims for personal injury and / or death, WILL BE GOVERNED BY THE LAWS OF THE REPUBLIC OF SOUTH AFRICA. IF ANY SECTION OF THIS AGREEMENT IS FOUND TO BE UNENFORCEABLE, THE REMAINING TERMS SHALL BE FULLY ENFORCEABLE; THIS AGREEMENT SHALL BE BINDING TO THE FULLEST EXTENT PERMITTED BY LAW. This Agreement shall be binding upon the ADULT and, if applicable, MINOR and their assignees, subrogees, distributees, heirs, next of kin, executors and administrators and may be pled by Albion Wheelers or the other Indemnified Parties as a complete bar and defense against any claim, demand, action or cause of action by or on behalf of the ADULT and / or MINOR. If this agreement is executed by a parent or guardian on behalf of MINOR, ADULT agrees that it is executed with the full understanding and intention that MINOR will be fully bound by its terms and understands that if this agreement were not so executed, MINOR to abide by the rules and regulations of the Event.
