Puawai Colour Run WAIVER & RELEASE
In order to participate in the Puawai Colour Run, participants must agree to the terms set out below and sign the document. If a child is participating, a parent/caregiver or legal guardian must sign this on their behalf. I understand that the Puawai Colour Run involves using public areas and roads by other people and traffic. I am aware of the hazards involved, which include but not limited to; traffic, actions of other participants, spectators, race volunteers, weather conditions, my physical and mental health, and the terrain of the course. In my judgement, I have sufficient understanding and competence to participate in the Puawai Colour Run safely. I agree to providing information about myself including but not limited to; name, date of birth and medical conditions I certify that I am able to take part in the Puawai Colour Run and I have not been advised otherwise by a medical professional. To my knowledge I have no underlying medical conditions which may impact my ability to participate. I will follow the designated course set out for the race, abide by the rules of the road and race rules and agree to follow all instructions set by race volunteers at all times. I acknowledge that failure to do this may result in my removal from the race and disqualified. I understand that my entry fee is non-refundable should the Puawai Colour Run be cancelled due to weather conditions, natural disasters, “acts of god”, terrorism, war, any other reason so determined by the race organisers or personal circumstances arise that prevent me from participating. I hereby waive, release and discharge from any and all liability for death, disability, personal injury, loss or damage of property and all other foreseeable risks, claims or actions of any kind (including negligence) whatever and however the occurring which may arise, at any time, from or in connection with, directly or indirectly, my participation in the Puawai Colour Run the following persons or entities: The Race Organisers, officials and volunteers, local council, land managers, event sponsors, representatives and agencies. I hereby indemnify and hold harmless the persons or entities mentioned above from any and all liabilities, claims or actions (including negligence) whatever and however caused which may arise, at any time, as a result of or in connection with, directly or indirectly, my participation in the Puawai Colour Run and vis-a-vis any third party, as far as this third party suffered from any damage or injury during the race due to my participation in the event. I acknowledge that the race organisers reserve the right to alter the advertised course or start time (at their absolute discretion). I consent to receive any medical treatment that may be deemed necessary in the race of injury, accident or illness during the Puawai Colour Run, and I allow that information be passed onto the race organisers or third parties (as deemed necessary by the race organisers). I authorize the use of my name, voice and picture to be used without payment in any broadcast, communication, promotion or advertisement, and I also agree that the information I have provided may be used by third parties and race organisers for the purpose of promoting future or other events, sponsors products and services. I know that I won’t have the right to approve any material and I do not expect to gain financially from my appearance in any race-related material. I acknowledge that the race organisers have absolute discretion in the award of any prizes and I will abide fully and without dispute with all such decisions of the race organisers. I have read and understood the information provided to me about the Puawai Colour Run and agree to attend the race registration and safety briefing. I understand the conditions and clauses in this document and I agree to adhere to these at all times. I have read and voluntarily signed this waiver & release and liability discharge form and explicitly agree to its content. |
