This is a legally binding agreement. Please read this entire document carefully.


I, the undersigned, expressly accept and agree to the following terms and conditions (hereinafter, collectively, the “Release Agreement”) in consideration for my volunteer participation in the FLRC Track Meets 2026 (2025-ACHFNW) program/activity (hereafter called “Event/Activities”) at Cornell University.


Consent to Participate and Assumption of Risk: I consent to my volunteer participation in the Event/Activities knowing the potential dangers, hazards, and risks of injury and illness that may arise and that it is not possible to specifically list every individual risk of injury and illness: Abrasions; Bruises; Torn, Pulled/Strained Tendons, Ligaments and/or Muscles; bone joint dislocation; Fainting; Nausea and/ or vomiting; Broken Bones; Head/Eye Injuries; Concussion; Brain Damage; Paralysis; Traumatic Brain Injury; Back/Neck/Spine Injuries; Slips, trips and falls from traversing uneven terrain; Contact with physical objects; Contact with/being bitten or stung by animals such as insects; Lacerations; Extreme weather conditions including sun, rain, wind, hail and lightning; hypothermia, dehydration, Heart Attack; Heat Exhaustion; Stroke; Trauma from Physical Contact with Participants; Allergies and reactions and illness due to exposure to food, beverages, plants, and other consumed or topical products; Equipment failure; Death; etc. I am also aware that the risks involved may include the use of chartered, private and/or rented passenger vehicles not owned or controlled by Cornell University. I hereby expressly assume all of the delineated risks in this event.


AGREEMENT TO ASSUME RISKS: By signing below, I acknowledge and agree that these are inherent risks of the activity and that I understand I may be exposed to each of these risks and other risks of injury or death by choosing to participate in this Event/Activities. I acknowledge and agree that my participation is voluntary and that if I believe any activity is unsafe for any reason, including the degree of skill required and my proficiency with that skill, I will immediately discontinue my participation in the activity. I further acknowledge and agree that I am voluntarily assuming all the inherent risks of participation.


Infectious Disease Assumption of Risk, Waiver, and Release of Liability: I understand and acknowledge that COVID-19 is a global pandemic and a public health risk. I understand that the risk of becoming exposed to or infected by COVID-19 or other infectious diseases at Cornell University may arise from the actions, omissions, or negligence of myself and/or others. I recognize that the University cannot limit all potential sources of infection, including but not limited to COVID-19. I knowingly and voluntarily assume all risks, including but not limited to, the risk of illness, death, bodily injury, disability, or exposure or infection with COVID-19 or other infectious diseases, for myself, and my family. I fully understand the risks, I knowingly and voluntarily waive and release Cornell University, its trustees, officers, agents, volunteers, employees, and students (the “Released Parties”) from all present and future claims of any type, including negligence, for any harm or loss, including but not limited to, economic loss, personal injury, disease, death or property damage suffered by me or my family, as a result of my participation in a Cornell University program or activity or as a result of my presence on Cornell University’s campus.


HOLD HARMLESS: I agree to indemnify, hold harmless, and covenant not to sue the Released Parties for any personal injury, death, medical expenses, disability, loss of capacity, property damage, court costs, attorney’s fees, or other loss arising out of the Event/Activities.


RELEASE AND WAIVER OF CLAIMS: In consideration of the opportunity to participate in this Event/Activities, which may include use of Cornell facilities, equipment, and property, use of Event/Activities equipment, and travel associated with this Event/Activities, I hereby release and waive all claims against the “Released Parties” from any liabilities, damages, expenses, causes of action, claims, or demands of any nature whatsoever, including any claims of negligence, on account of personal injury or any of the acknowledged risks outlined above, exposure to COVID-19 or other infectious diseases, property damage, death, or accident of any kind related to my participation in this Event/Activities, however caused, except in the event of gross negligence. I intend for this release and waiver to bind my family members, heirs, executors, administrators, representatives, and assigns, as well as myself.


I understand that neither Cornell University nor Cornell Athletics provides any accident or medical insurance and that I am required to provide my own accident and medical insurance. I hereby agree that I am financially responsible for all such expenses. I understand Cornell Athletics does not carry radios or cell phones, and I may be far from medical facilities.


I understand that neither Cornell University nor the Cornell Athletics, provides any private vehicle insurance and that I am required to provide my own private vehicle insurance should I elect to use my own vehicle for transportation to or from the Event/Activities. In the event of an accident or injury in my private vehicle or any other private vehicle in which I may ride to or from this Event/Activities, I agree to the same terms outlined above.


I understand that all participants are subject to Cornell University regulations including its policies and procedures, Cornell Athletics policies, laws of the United States, and the laws of New York State. In the event of violation of these or behavior that is considered by Cornell Athletics to be detrimental to me as a participant, other participants, or the Event/Activities program, Cornell University/ Cornell Athletics shall have the right to dismiss me from the Event/Activities while retaining all payments.


This Release, Assumption of Risk and Hold Harmless Agreement shall be governed by the laws of the State of New York, without consideration of its conflicts of laws principles, and any dispute about the terms shall be brought in a court of competent jurisdiction in the State of New York with venue in Tompkins County.


- I hereby certify that I am physically fit and able to participate in this activity.
- I certify that I am of lawful age and legally competent to sign this Release, Assumption of Risk and Hold Harmless. I understand that minors may not sign this form. I understand the terms herein are contractual.


I have read and fully understand the above warnings, agree to assume all risks, and agree to all of the foregoing conditions. I have signed this document of my own free will and agree to the terms outlined herein.

I, the undersigned, parent or guardian of (Name of Child/Youth) a minor under eighteen (18) years of age, expressly accept and agree to the following terms and conditions (hereinafter, collectively, the “Release Agreement”) in consideration for my child’s volunteer participation in the FLRC Track Meets 2026 (2025-ACHFNW) program/activity (hereafter called “Event/Activities”) at Cornell University.

Release of Liability and Hold Harmless for Cornell University: I hereby for myself and on behalf of my heirs, family members, executors, administrators, assigns, personal representative, and next of kin, agree to RELEASE AND HOLD HARMLESS, Cornell University, its trustees, officers, agents, volunteers, and employees and students (collectively, the “Released Parties”) from any liabilities, damages, expenses, causes of action, claims, or demands of any nature whatsoever, including any claims of negligence, on account of an accident, personal injury or any of the acknowledged risks outlined above, property damage or even death, however, caused within the scope of this Program.

I agree to indemnify, hold harmless, and covenant not to sue the Released Parties for any personal injury, death, medical expenses, disability, loss of capacity, property damage, court costs, attorney’s fees, or other loss arising out of the Program.


Cornell University Does Not Provide Insurance and Parents Are to Inform Cornell University of Any Special Needs: I understand that Cornell University does not provide any Accident or Medical Insurance with respect to this Program. I am responsible for providing any Accident or Medical Insurance, and it will be my responsibility to pay for emergency room care, doctors’ services, hospitalization, and any other related costs, medical or non-medical. I further acknowledge that I will take all precautions that I deem necessary for my child’s personal safety and well-being, including, but not limited to, medical precautions as needed prior to the start of the Program.


Consent to Recording and Media Release: I authorize Cornell University to photograph, audio, and/or video record my child during the Program; and use or distribute any pictures, audio, or video recording related to the program, camp, or activity in which my child is depicted without limitation. Cornell University is granted permission to use such materials for educational fund-raising, business activity including submission of grants, and publicity about the program worldwide. I further consent to Cornell University preserving these recordings until four years after my child turns eighteen (18) years of age.


Theft, Damage, or Loss to Child’s Personal Property: I understand that Cornell University is not responsible for any theft, damage or loss to my child’s personal property while participating in Program/.


Adherence to Standards: I understand that my child must abide by all laws, regulations, Cornell University procedures, policies, and rules at all times during my child’s participation in the Program. I understand that if I permit my child, or if my child chooses to participate in any conduct, excursions, or other activities in violation of Cornell University procedures, policies, and rules prior, during or after the Program, which are not included or part of the scheduled Program, that they do so voluntarily, and that Cornell University is not responsible for my child or my child’s actions.


Potential Disputes Resolved in Tompkins County: I agree that this Release Agreement shall be governed by the laws of the State of New York, without regard to conflicts of laws principles. I agree that any dispute about the terms of this Release shall be presented to a court of competent jurisdiction in the State of New York with a venue in Tompkins County.


Parental/Guardian Certification: I certify that I have read (or had someone read to me) and understand this entire Release Agreement, and understand the dangers involved in participating in this Program. I am fully aware of the legal consequences of this Release Agreement, and I agree to its terms. I represent and warrant that I am eighteen (18) years of age or older and have the legal authority to execute this Release Agreement on behalf of the listed child.


I have read and fully understand the above warnings, agree to assume all risks, and agree to all of the foregoing conditions. I have signed this document of my own free will and agree to the terms outlined herein.

FLRC Event Waiver of Liability


The Finger Lakes Runners Club welcomes you to the January Jicker Indoor Track Meet (“the Event”). To participate in the Event, you must agree that you understand the risks involved, would be considered physically capable and properly trained by a certified coach, and will follow all decisions by race officials.

 

Risks & Hazards

I acknowledge and assume all risks associated with participating in the Event, including but not limited to: falls; physical contact with other participants, volunteers, race personnel, contract service providers, and spectators; the effects of weather including high heat and humidity, lightning and thunderstorms, strong winds and hail, poor air quality and wildfire smoke, severe storms and flash flooding, and cold temperatures and slippery surfaces; coming in contact with animals both wild and domestic; the potential for exposure to communicable diseases; and all other conditions of the course and venue.

 

Additional risks specific to track meets include: synthetic track surface hazards; crowded racing conditions; spike-wearing competitors; hurdles and other track equipment; starting blocks; throwing implements; sand pit and surrounding surface hazards; vertical jumping hazards including landing mats, standards, and bars; and the intensity of sprint and jumping events.

 

I recognize that these risks may result in muscle strains and tears; sprains; joint injuries; broken bones; head injuries including concussion; weather-related conditions including heat exhaustion, heat stroke, hypothermia, frostbite, and harm from lightning strikes; cardiac events including strokes and heart attacks; and other serious injuries or death.

 

Rules & Requirements

I agree that bicycles, skateboards, baby jogging strollers, roller skates or inline skates, and animals are not allowed in races unless explicitly permitted by the race director, and I will abide by all race rules.

 

Release

Having read this waiver and knowing these facts, and in consideration of your accepting my entry, I, for myself and anyone entitled to act on my behalf, waive and release the Finger Lakes Runners Club, its officers, directors, and volunteers; any medical or rescue personnel including but not limited to emergency responders, search and rescue teams, and medical volunteers; Cornell University; the Road Runners Club of America; USATF; and their representatives and successors (collectively, “Released Parties”) from all claims or liabilities of any kind arising out of my participation in the Event, even though such liability may arise out of negligence or carelessness on the part of the Released Parties.

 

Specific Authorizations

I grant permission to the Released Parties to use my name, results, photographs, motion pictures, recordings, or any other record of the Event for any legitimate purpose, including promotional materials. I am aware that the Event does not offer refunds in the event of cancellation.

 

Acknowledgment

By signing below, I confirm that I have read and agree to the terms of this waiver. I acknowledge that participating in the Event is a potentially hazardous activity that could result in injury or death, and I accept all risks associated with participating in the Event. I certify that I am medically able to perform the Event, am in good health, and have received proper training. I agree to abide by any decision of a race official regarding my ability to participate in or complete the Event safely.

 

I certify that I am at least 18 years of age and voluntarily forfeit my right to sue. If signing on behalf of a minor participant, I affirm that I am their parent or legal guardian and have the authority to accept these terms on their behalf.
