Linger and Die Enduro Event Acknowledgement, Disclosure and Waiver
In this acknowledgement, disclosure and waiver form, the following terms have the following meanings:
‘Event’ means – the Linger and Die Enduro official practice day and competition;
‘Event organisers’ mean – the Event organisers including Mountainbikers of Alexandra Incorporated, the Race Director, all event officials and event volunteers.
I declare that:
1. My accepted entry into the Event will not be transferred to another entrant.
2. I agree to provide my photo identification and personally pick up the race pack, at the check-in prior to the event.
3. In the event of any ‘act of God’ conditions causing a cancellation of the Event, I agree that my total entry fee is not transferable or refundable.
4. I am in an appropriate physical and mental condition, have the required skills and have the appropriate equipment to safely participate in the Event and without causing harm to others, given the nature of the Event (such as the length, time, physical demands, technical terrain and environmental context).
5. I have taken medical advice on any known relevant pre-existing medical conditions, and confirm that it is medically safe for me to participate in the Event.
6. If, during the practice day, I determine that the course is beyond my capability to safely compete, I will withdraw from the Event and notify the Race Director and will not receive a refund of the entry fee.
7. It is my responsibility to have my bike, helmet and other safety equipment professionally checked before attending this Event.
8. I understand that all roads to the Event course are open to the public and agree to obey all road rules if riding on these roads.
9. I acknowledge that there are risks involved in the Event. I fully realise the dangers of participating in the Event, and fully assume the risks associated with my participation and my wellbeing and safety during and after the Event. I acknowledge that the Event organisers provide no warranties, regarding my wellbeing and safety.
10. I agree that situations may arise during the Event, which may be beyond the immediate control of the Event organisers.
11. I will participate in the Event, in a manner that does not endanger me or others.
12. I am fully and solely responsible for the security of my property at the Event.
13. I agree that, to the extent permissible by law, and regardless of cause or negligence, the Event organisers, the first aid providers, the Matangi Station pastoral lessee, Matangi Station MTB Limited, the landowner, the sponsors, and other parties associated with the Event, have no liability to me or my estate whatsoever for any direct or indirect loss or costs, (including, but not limited to injury, death, or property damage) sustained by me during or in any way related to my participation in the Event.
14. I authorise the Event organisers and sponsors to photograph, film and record me and to use of my name, voice, pictures, and information on this entry form, in any broadcast, telecast, promotion, advertising, publication, other media, and in any other way, without payment to me or any other form of compensation.
15. I consent to my name and contact details being included in the Event organiser’s database and being informed of upcoming events and newsletters, with the right to opt out of this service at any time.
16. I agree to comply with the rules of the Event.
17. I agree to follow all safety instructions provided to me by the Event organisers before, during and after the Event.
18. I consent to receiving medical treatment in the event of illness or injuries suffered during or immediately after the Event, including transport to a medical facility, and agree to pay all costs associated with that treatment and transportation.
19. I agree to be bound and governed by the laws of New Zealand and submit to the exclusive jurisdiction of the New Zealand courts.
20. My acknowledgements, agreements and consents in this form continue forever and are binding on my heirs, executors and personal representatives.
