WAIVER & RELEASE FROM LIABILITY
I, the registered and named participant, understand that participating in mountain bike racing has certain inherent risks or dangers. I understand these risks or dangers, known or unknown, anticipated or unanticipated, may result in injury, illness, disease, death or damage to myself or my property, or to other persons and their property.
For, and in consideration of, my participation in the Hidden Valley Hammer mountain bike event, I hereby personally assume all risks in connection with this activity.
I, my executors, administrators, heirs, and assignees do hereby release and discharge the Ely Nordic Ski and Bike Club, Superior National Forest, Minnesota DNR, St. Louis County, City of Ely and all agents, volunteers, sponsors, agencies, subsidiaries, affiliates, and beneficiaries jointly and severally from any and all present and future claims of liability. I, my executors, administrators, heirs, and assignees do hereby waive and hold harmless the Ely Nordic Ski and Bike Club, Superior National Forest, Minnesota DNR, St. Louis County, City of Ely and all agents, volunteers, sponsors, agencies, subsidiaries, affiliates, and beneficiaries jointly and severally, from and against any and all actions, claims, injuries, demands, liabilities, loss, damage or expenses of whatever kind and nature including, but not limited to attorney fees, which at any time may be incurred by reason of my participation in or my preparation for any of the aforesaid event.
I attest and verify that I have full knowledge of the risks involved in this event, and I am physically fit and sufficiently trained to participate.
If as a result of my participation in the Hidden Valley Hammer mountain bike event I require medical attention, I hereby give my consent to authorized medical personnel of the event to provide medical care as is deemed necessary.
I grant full permission to Ely Nordic Ski and Bike Club to use to my likeness, including photographs and video, for publicity and advertising purposes without compensation.
This Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I fully understand that by signing this form, I am giving up legal rights and/or remedies that may be available to me.
NOTE: If participant is under 18 years of age or has a legal guardian, this release must be co‐signed by a parent or guardian.
