In consideration of allowing my participation in the "That Dam Hill Marathon and Ultra Races (“That Dam Hill”), I hereby waive and release all claims and liabilities arising directly or indirectly out of, or relating to my participation in that event, and I further agree to indemnify and hold harmless That Dam Hill race committee, That Dam Hill race volunteers, the directors, trustees, officers, affiliates, agents, contractors, representatives, volunteers and the City of London from all losses, costs, liability, damages, and claims arising from my participation, notwithstanding that the same may have been contributed to or occasioned by any act or failure to act, including without limitation, negligence, breach of contract or breach of any statutory duty of care of the organizers and others.
I certify that I am adequately trained, physically fit, and capable of participating in this ultra-endurance event. I recognize the significant risks involved, including but not limited to: death, exhaustion, physical injury, heat stroke, dehydration, weather (including extreme heat, cold, and/or storms), and vehicle and pedestrian traffic. I freely accept and fully assume all such risks and the possibility of personal injury, death, property damage, expense and related loss, including loss of income. I recognize that endurance running is an inherently risky undertaking, and that the race organizers cannot possibly guard against every potential danger.
I also grant permission for photographs, video, and audio recordings of the event to be made, and agree that any such content may be disseminated, including (but not explicitly limited to) news media, That Dam Hill promotional materials, social media and the That Dam Hill website.
This agreement is binding on not only myself, but my next of kin, heirs, executors, administrators and assigns.
I HAVE READ THIS AGREEMENT AND UNDERSTAND IT. I AM AWARE THAT BY AGREEING TO THIS DOCUMENT THIS DOCUMENT I AM WAIVING CERTAIN RIGHTS WHICH I OR MY NEXT OF KIN, HEIRS, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE CITY OF LONDON, THE THAT DAM HILL ORGANIZING COMMITTEE & VOLUNTEERS AND OTHERS. |
