IN CONSIDERATION of being permitted to attend and participate in the SPC ZACHARY SALMON SOLIDER RUN, EACH OF THE UNDERSIGNED, for them, their personal representative, and/or heirs-at-law, agree as follows:
The undersigned HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE THE UNION ADOPT-A-UNION, from any and all liability to the undersigned, their personal representatives, assigns, heirs, next of kin, sponsors, or volunteers, for any and all loss or damage, and any claims or demands arising out of or related to the SPC ZACHARY SALMON SOLIDER RUN, whether caused by the negligence of the UNION ADOPT-A-UNIT or by a Third Party. The undersigned understands that the Covid pandemic is still in progress and understands that the race sponsors cannot ensure against the transmission of the Covid virus between the participants.
The undersigned HEREBY AGREES that this Release and Waiver of Liability and Assumption of Risk Agreement EXTENDS TO ALL ACTS OF NEGLIGENCE by the UNION ADOPT-A-UNIT, and its intended to be as broad and inclusive as is permitted by the Laws of the Commonwealth of Kentucky and that if any portion herein is held invalid, it is agreed that the balance shall continue to be in full force and legal effect.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. I FURTHER CERTIFY THAT I AM PHYSICALLY ABLE TO PARTICIPATE IN THIS EVENT AND AGREE TO RECEIVE E-MAIL INFORMATION CONCERNING THE EVENT.
