April is Sexual Assault Awareness and Prevention month. As a community we would love to see this issue get to zero. We can only do this if we band together and promote dignity and respect for all. Our theme for this year is Superheroes Ask. Be A Superhero and join us for this free event. As many of you are aware the World Health Organization has been following the concern and global spread of the novel coronavirus, COVID-19 since the end of January. The Centers for Disease Control and Prevention has recently recommended that for the next eight weeks events with attendance of greater than 50 people be cancelled or postponed and Oregon has recommended no more than 25.

In light of the recommended guidance and the desire to protect the health and wellbeing of our community we will be holding the Klamath Falls Race to Zero for Sexual Assault as a virtual race event for the entire month of April. We want to continue to honor and show our support for victims and survivors if we are able. We ask that participants register and complete their preferred race distance between April 1st and April 30th. Following completion of your distance, post a photo of your accomplishment on the Klamath Falls Race to Zero Facebook page https://www.facebook.com/KlamathFallsR2Z. Ideally, our committee hopes that once we have the all clear from COVID we can host an event for swag bag pick up, raffle prizes, showcase our community supports, and have some variation of a speak out event…but we shall see what the next few weeks bring.

I understand, agree, warrant and covenant as follows:

1. Authority to Register and/or to Act as Agent. You represent and warrant to the 173d Fighter Wing (collectively "SAPR Team") that you have full legal authority to complete this event registration on behalf of yourself and/or any party you are registering (the "Registered Parties"). As used in this Agreement and Waiver, SAPR refers to the Sexual Assault Prevention and Response of the 173d Fighter Wing and any and all subsidiaries, affiliated entities, or entities, including the Oregon Air National Guard and the Oregon Military Department, and its officers, employees, contractors, subcontractors and agents. If you are registering a child under the age of 18 or an incapacitated adult you represent and warrant that you are the parent or legal guardian of that party and have the legal authority to enter into this agreement on their behalf and by proceeding with this event registration, you agree that the terms of this Agreement and Waiver shall apply equally to all Registered Parties. By registering a child under 18, you agree and consent to the collection of that child's information which you provide for the purposes of registration.

2. Waiver. YOU UNDERSTAND THAT PARTICIPATION IN THE 2 / 5 KILOMETER RUN/WALK, AND ASSOCIATED ACTIVITIES, IS POTENTIALLY HAZARDOUS, AND THAT A REGISTERED PARTY SHOULD NOT PARTICIPATE UNLESS THEY ARE MEDICALLY ABLE AND PROPERLY TRAINED. YOU UNDERSTAND THAT EVENTS MAY BE HELD IN FACILITES OPEN TO THE PUBLIC DURING THE EVENT AND UPON WHICH HAZARDS ARE TO BE EXPECTED. PARTICIPATION CARRIES WITH IT CERTAIN INHERENT RISKS THAT CANNOT BE ELIMINAT- ED COMPLETELY RANGING FROM MINOR INJURIES TO CATASTROPHIC INJURIES INCLUDING DEATH. YOU UNDERSTAND AND AGREE THAT IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THE EVENT, YOU – AND/OR ANY PARTICIPANT ON WHOSE BEHALF YOU SIGN – FOR YOURSELF, FOR HIM- OR HERSELF, AND FOR ALL HEIRS, PERSONAL REPRESENTATIVES OR AS- SIGNS, BY YOUR SIGNATURE BELOW, RELEASE, WAIVE, DISCHARGE ALL CLAIMS, AND CONVENANT NOT TO SUE, FOR ANY AND ALL

3. Severability. You further expressly agree that this Agreement and Waiver is intended to be as broad and inclusive as is permitted by the law of the State of Oregon and that if any provision of this Agreement and Waiver shall be found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and Waiver and shall not affect the validity and enforceability of any remaining provisions.

BY INDICATING YOUR ACCEPTANCE OF THIS AGREEEMENT AND WAIVER, YOU ARE AFFIRMING THAT YOU HAVE READ AND UN- DERSTAND THIS AGREEMENT AND WAIVER AND FULLY UNDERSTAND ITS TERMS. YOU UNDERSTAND THAT YOU ARE GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. YOU ACKNOWLEDGE THAT YOU ARE SIGNING THE AGREEMENT AND WAIVER FREELY AND VOLUNTARILY, AND INTEND BY YOUR ACCEPTANCE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
